<p>FRANKFORT, Ky. – Kentucky was considered to be on the fast-track to sports betting, a leader amongst the states comprising the so-called “second wave” of sports wagering legalization. Unfortunately, <a href="https://apps.legislature.ky.gov/record/19rs/hb175.html">HB 175</a> no longer has adequate support this term, and it has been shelved until 2020.</p>
<p>Rep. Adam Koenig (R), primary sponsor of the bill, indicates that the primary hurdle for the bill was this congressional session’s requirement that the law for <a title="Kentucky Sports Betting" href="https://www.sportsbettinginkentucky.com/" target="_self">Kentucky sports betting</a> be passed with a supermajority of votes.</p>
<p>In Kentucky, a three-fifths (60%) supermajority is required for any bill that would establish new sources of tax revenue or raise taxes. This applies to odd-numbered years only. As such, in 2020, HB 175 – and/or other bills like it – will be able to be passed with a simple majority (51%).</p>
<p>Given that the bill would likely pass under those terms this year, there is ample reason to assume that sports betting legalization would have no trouble passing in the next legislative session.</p>
<p>Koenig told <a href="https://insiderlouisville.com/government/state/sports-wagering-bill-likely-dead-for-this-session-says-sponsor/" rel="nofollow noopener">Insider Louisville</a> of the decision to shelve the bill until next year.</p>
<p>“We will regroup and reload with a better plan to win the hearts and minds of the public next year. We will only need a simple majority, and it will be a budget year where that $20-48 million will look a lot more important.”</p>
<p>In the meantime, here’s a look at what’s in HB 175. The main thrust of the proposal’s content shouldn’t change much (if at all) in the meantime.</p>
<p class="green-bg">HB 175 – Kentucky’s Sports Betting Legalization Bill</p>
<p>Though sports wagering is the most popular gambling platform right now, HB 175 addresses other aspects of gaming as well. These include considerations for daily fantasy sports (DFS) and the establishment of various gambling-related government agencies and funds. Also included is the establishment of regulated, legal, online-based poker.</p>
<p class="green-bg">Sports Betting Highlights In HB 175</p>
<ul class="lists-news">
<li>Sports wagering will be overseen by the Kentucky Horse Racing Commission (KHRC)* http://khrc.ky.gov/Pages/default.aspx * .</li>
<li>Online sports wagering is allowed, provided participants use authorized apps or Internet accounts and register in-person at the physical bookmaker’s venue.</li>
<li>The legal sports wagering age will be set at 18 years old.</li>
<li>No professional or amateur game that is being played inside the state of Kentucky will be allowed to have odds offered.</li>
<li>NCAA games may be wagered on, though Kentucky books may not include odds for teams from the state.</li>
<li>Oscars/entertainment betting is allowed at the discretion of the KHRC.</li>
<li>There is no “integrity fee” allotment to sporting leagues, though the law would establish “monitoring programs to ensure the highest integrity of athletic events and sports wagering.”</li>
<li>The bill nominally allows sports wagering at “professional sports venues”.</li>
<li>Sports betting tax rates are set at 10.25% for in-person adjusted gross revenues and 14.25% for online/app-based adjusted gross revenue.</li>
<li>Initial operator license fees are set at $1 million, and annual renewal fees are set at $50,000.</li>
</ul>
<p class="green-bg">Daily Fantasy Sports Highlights In HB 175</p>
<ul class="lists-news">
<li>DFS operators have until January 15, 2020, to register with the state.</li>
<li>The KHRC will also oversee DFS operations, though these are not classified as “sports betting” by the state.</li>
<li>Fantasy operators who have fewer than 100 participants within any calendar year are exempt from registration/regulation requirements.</li>
<li>The legal age to participate in DFS contests is 18 years old.</li>
<li>DFS operators must pay a $5000 registration fee and must play annual renewal fees of either 6% of adjusted gross revenues or $5000, whichever is greater.</li>
</ul>
<p class="green-bg">Online Poker Highlights In HB 175</p>

<li>The Kentucky Lottery Corporation will oversee the legal online poker industry.</li>
<li>The initial online poker operator license is set at $250,000. Annual renewal of this license costs $10,000.</li>
<li>Net online poker revenue will be taxed at 6.75%.</li>
<li>The legal age to play online poker in Kentucky is 18 years old.</li>

	<p><em>FRANKFORT, KY</em> – The topic of legal sports betting has been a growing trend across the United States in the past few months, and Kentucky may soon be in that number. If everything goes through with a recent bill proposal, then Kentucky residents could have legal sports gambling in their own state.</p>
<p class="green-bg">The Scope Of The Bill</p>
<p><a href="https://apps.legislature.ky.gov/record/19rs/hb175.html" rel="nofollow">KY House Bill 175</a>, if passed, would allow land-based sports gambling at horse racing tracks or the Kentucky Speedway. Residents looking to bet on horses would also be able to bet on their favorite sports teams.</p>
<p>For Residents wanting to stay in the comfort of their home, the bill would also allow for internet poker and fantasy sports gambling as well.</p>
<p class="green-bg">What The State Thinks About The Bill</p>
<p>“We’ve been pushing this thing pretty hard,” said Ellis Park Race Track General Manager Jeff Hall. “We fight for Kentucky dollars we’re losing to Indiana.”</p>
<p>The need for financial gain to compete with nearby states is only a sliver of the needs the bill can supply the area with.</p>
<p class="green-bg">What This Means Financially For Kentucky</p>
<p>Betting on sports in Kentucky would line the state’s pockets with potentially millions of dollars in tax revenue. Tax revenue that could enable the state to fix up Ellis Park into something amazing.</p>
<p>“Our first impression, you’re not going to know the place, let me put it to you like that,” said Ellis.</p>
<p>The money gained from the bill would also greatly benefit Kentucky Residents. Dollars would be used to help people struggling with gambling addiction. Funds would also go to Kentucky’s struggling pension systems.</p>
<p class="green-bg">What Happens Next</p>
<p>Kentucky’s legislative committee approved the bill on Tuesday, and now the Kentucky House has plans to vote on the bill this week. If the bill gets past the House, then it will need approval from the Senate. <a title="Kentucky Sports Betting" href="https://www.sportsbettinginkentucky.com/" target="_self">sports betting in Kentucky</a> is within arm’s reach for residents of the Bluegrass State. They surely need this bill, if not purely for the financial implications and benefits it will provide.</p>

	<p><em>Louisville, KY</em> - Churchill Downs Inc. (CDI) has decided to take matters into their own hands when it comes to slot machines in Kentucky. Rather than waiting for traditional slots to be legalized, the horse racing and casino gaming operator has opted to incorporate ‘instant racing’ machines.</p>
<p>CDI plans to construct a new facility at its old Trackside training location that will hold up to 600 ‘instant racing’ machines. The Kentucky Horse Racing Commission has already provided the necessary signatures for the operator to start building the venue that is estimated to cost between $50 million and $60 million. Limited space at their Churchill Downs location prompted the need for the custom-built facility that will be 85,000 square feet.</p>
<p class="big-red">What Is Instant Racing?</p>
<p>Instant racing, also called historical race wagering, is a type of electronic machine that allows horse enthusiasts to bet on horse races that have already occurred. All information that would reveal identifying details of the race are hidden, and patrons are instead provided with limited profiles of the horses, jockeys, etc. to decide on the horse(s) they would like to wager on. The gambling system is similar to a traditional slot machine, specifically when it comes to the element of chance.</p>
<p class="big-red">Historical Racing Around Kentucky</p>
<p>Interestingly enough, though CDI is just getting onboard with historical racing machines, instant racing is nothing new to the state of Kentucky. Judge Thomas Wingate ruled back in December 2010 that K.Y. statutes permitted residents to place bets on instant racing machines. The main reason that CDI opted not to offer instant racing sooner is because the operator believed that real slot machines would be legalized sooner than later. This has not been the case, as legislators in the Bluegrass State have given no indication that gaming expansion will be a priority in the upcoming session.</p>
<p>In the weeks before CDI’s new facility was announced, there were already 1,724 instant racing machines scoured around the state. The historical racing machines at Ellis Park, the Red Mile and Keeneland, and Kentucky Downs brought in more than $88 million in bets in May 2017.</p>
<p class="big-red">Instant Racing Revenue</p>
<p>In Kentucky’s current fiscal year through the end of May, instant racing brought in nearly $839 million with about $53 million going to the racetracks. There has been $5.4 million for the Thoroughbred purses and almost $4.7 million produced for the Kentucky General Fund.</p>
<p>Historical racing is expected to increase CDI’s overall revenue, which land-based horse racing betting contributes to the least. As indicated in the company’s first quarter earnings report, race betting revenue came in at $26.1 million, casinos brought in $35.5 million, online betting generated $52.3 million, and social gaming racked in $112 million.</p>
<p>With the new machines- which are expected to debut summer 2018 - CDI will able be able to create a new revenue stream while simultaneously releasing pressure on on-track horse racing betting income. Over in Florence, Turfway Park has been also been approved for instant racing machines though they are not yet operational for <a title="Kentucky Sports Betting" href="https://www.sportsbettinginkentucky.com/" target="_self">Kentucky sports betting</a>.</p>
